Description

Law n° 220 of 14 November 2016 “Disciplina del cinema e dell’audiovisivo” establishes the ‘Film and Audiovisual Fund’ aimed at funding works   through tax credits, automatic contributions and selective contributions.
Automatic contributions, governed by the DM 342 of 15/07/2021 vare granted by the Ministry of Culture to film and audiovisual companies for the development, production and distribution, in Italy and abroad, of new Italian film and audiovisual works.
Funding amounts are calculated on the basis of the financial, cultural, artistic and broadcasting results with national and international audiences of film and audiovisual works produced or distributed by each beneficiary company.
The annual budget is divided up as follows:

  • Films 63% of which: 
    • 50% goes to the portion of funding awarded on the basis of financial results;
    • 50% goes to the portion of funding awarded on the basis of cultural and artistic results.
  • Television works and web products 18% of which:
    • 50% goes to the portion of funding awarded on the basis of financial results;
    • 50% goes to the portion of funding awarded on the basis of cultural and artistic results.
  • Video games: 4% on the basis of cultural and artistic results.
  • Animated works: 8% on the basis of financial, cultural and artistic results.
  • International distributors: 5% on the basis of financial and cultural results from sales and pre-sales on markets other than the Italian market of film, television and web products.
  • Home Entertainment publishers: 2% on the basis of financial and cultural results from transactions in Italy of television and web products.

Maximum quota on cost

Automatic contributions and other public support measures must not exceed 50% of the costs of the work subject to reinvestment.

This limit is raised to 60% for the works indicated in article 54(7a) of Regulation EU No. 651/2014.

The limit is further raised to 100% of total costs for:

  • works indicated in article 54(7b) of Regulation EU No. 651/2014;
  • works that have been granted the selective contributions indicated in article 26 of Law no. 220/2016;
  • works with total production costs of less than €2,500,000;
  • films distributed in theaters below 20% of the total number of active theaters.

Requirements

  • Italian nationality must be requested
  • The opening of a account with the Ministry.
  • For international productions or co-productions, the share of ownership of the work held by the Italian producer must be no less than 20%.
  • Automatic contributions are granted for the production of new works under the following conditions:
    a) for films, to cover necessary investment during the development, production, national and international distribution and home entertainment distribution;
    b) for television and web works, to cover the investment necessary for production, national and international distribution and home entertainment distribution.

Payment schedule

The account opened with DG Cinema is used to deposit the amounts accrued annually on the basis of the financial, artistic and cultural results of each of the works produced or distributed by the company holding the account. The total amount deposited constitutes the potential fund of the company, on the basis of which automatic contributions are granted for the development, production and distribution in Italy and abroad of new Italian film and audiovisual works that meet the cultural eligibility requirements laid down by the law.

Contributions are paid at the request of the company and, where possible, at different stages of progress, according to technical provisions laid down in the decree issued by the Directorate-General for Cinema and Audiovisual.
